Obiettivi formativi
The course intends to provide students with an understanding of the legal and policy frameworks governing environmental problems at the European level within the concept of sustainable development. Special attention is drawn to the notion of environment, EU environmental law sources and principles, prevention and remediation of environmental damage and liability mechanism, enforcement of the EU environmental law at Member States levels, environmental impact assessment, waste policy, techniques for environmental management. The course examines also leading cases in EU law and the regulation, challenges and opportunities faced by specific sectors in particular: Biodiversity, Waste Policy and Management, Public Procurement.
The contents of course allow students to get aware of the public point of view of common goods safeguard and management, and - together with the courses of Law of territorial government and public contracts and Natural Resource Economics - will lie down the economic and legal bases for design and coordinate interventions of protection and enhancement of environment and territory.
Risultati apprendimento attesi
Knowledge and understanding. At the end of the course, students will know the legal and policy frameworks governing environmental problems at the European level and will be able to understand their complexity, challenges and opportunities.
Applying Knowledge and Understanding: At the end of the course, students will be able to locate and analyse EU environmental law and case law and apply environmental general principles to key environmental problems.
The students will develop analytical and problem-solving skills also through case studies, class projects and discussions.

- Introductory notions of public law and the different legal systems (International, European, and Italian)
- Environmental protection in International law
- Environmental protection in EU law
- Environmental protection in Italian law: the environment in the Constitution; the Environmental Code; public and private actors working for environmental protection; administrative activities for environmental protection (procedural peculiarities, an overview of environmental procedures, the right of access to environmental matters, emergency management), liability for environmental damage.
- Analysis of some of the most significant special sectors.
Prerequisiti
No preliminary competences are required to attend this course.
Metodi didattici
Regular attendance is highly recommended.

The course includes lectures, in-depth seminars, and in-class presentations of case studies.

Modalità di verifica dell’apprendimento e criteri di valutazione
Oral Exam.

During the course, on dates announced in class, two written tests will be held on the topics covered in lessons. These tests will consist of 20 multiple-choice questions to assess knowledge of the exam syllabus and one open-ended question to evaluate independent critical thinking on key points of the program. Additionally, group work will be organized for the in-class presentation of case studies.

Grading Scale: 18-30/30
For those participating in the written tests and the case study presentations, the final grade will be the average of the scores from the various assessments, rounded up. The overall score for each written test is determined by the sum of points earned as follows: each correct answer in the multiple-choice section is worth 1 point; the open-ended question is worth 10 points.
