Learning objectives
The course aims to increase the knowledge of the evidentiary dynamics in the criminal process in the light of the probative procedure in its different stages and the different procedural models. The relationship between the preliminary phase and the debate is a necessary foundation for understanding the accusatory system.
Expected learning outcomes
Ability to apply evidence discipline to concrete cases. Critical judgement on the application of the test evaluation criteria. Ability to apply the rules of evidence in the light of European and supranational sources and the jurisprudence of the Higher Courts.

Course syllabus
In the 6-credit course, the basic issues underlying evidentiary discipline will first be dealt: the right to the test, the ex officio test, the criteria of admission, acquisition and evaluation. Furthermore, will be dealt the issue of exclusionary rules.
The 9-credit course adds topics and issues relating to special proceedings in criminal matters to the 6-credit program.
Prerequisites for admission
The course is open to students who have already taken the examination of Criminal Law and Criminal Procedural Law.
Teaching methods
The 6-credit course is dedicated to the topic of evidence which will also be analyzed in light of constitutional and conventional rules as well as constitutional and European jurisprudence. Practical cases will also be dealt in seminar meetings.
The 9-credit course adds the topics of greatest interest regarding special proceedings to the 6-credit program, also examining practical cases and recent jurisprudence.

Assessment methods and Criteria
The final exam is held in oral form and the evaluation is expressed with a grade in thirtieth, with possible praise. The criteria for the evaluation of the oral test take into account the correctness of the contents, the understanding of the systematic links, the clarity of the exposure and the ability to analyze.
